Maine Governor Vetoes Data Center Ban, Cites Need for Existing Projects

Maine Governor Janet Mills has vetoed a bill aiming to temporarily halt the construction of large data centers in the state. The governor's decision was influenced by the desire to accommodate an existing data center project.
In a move that may ripple through the burgeoning tech infrastructure landscape, Maine Governor Janet Mills has vetoed a bill that sought to impose a moratorium on the construction of large data centers within the state until the fall of 2027. While the proposed legislation had successfully passed both houses of the Maine legislature, Governor Mills indicated her preference for a bill that would allow an existing data center project in Jay, Maine, to proceed.
The vetoed bill was designed to specifically block the development of data centers requiring 20 megawatts of power or more, and would have prohibited state agencies from issuing permits for projects falling outside these energy consumption parameters. Furthermore, the bill mandated the establishment of a "Maine Data Center Coordination Council" tasked with providing strategic guidance and evaluating policy tools related to data center development.
Although Governor Mills did not sign the bill into law, she has signaled her intention to issue an executive order to establish a council similar to the one proposed. Additionally, she signed LD 713, a separate piece of legislation that prevents data centers from accessing Maine’s business development tax incentive programs. This suggests a nuanced approach to data center development, balancing the state's energy and planning concerns with economic opportunities.
Maine is not alone in its deliberations over data center expansion. At least a dozen other states are reportedly exploring similar legislative measures. New York, for instance, recently saw a bill introduced that could block new data center construction for a minimum of three years. On a federal level, a bill endorsed by Senator Bernie Sanders and Representative Alexandria Ocasio-Cortez proposes a nationwide pause on new data center construction and upgrades to existing facilities.
These regulatory considerations come at a time when the demand for data center infrastructure, crucial for the advancement of AI, is rapidly increasing. This trend, however, appears to be at odds with federal initiatives, such as the Trump administration's recent AI framework, which actively advocates for streamlining the buildout and powering of data centers to accelerate AI development across the United States.
